Lynn L. Bergeson, founder and managing partner of B&C® Consortia Management, L.L.C. (BCCM) and owner of Bergeson & Campbell, P.C. (B&C®), counsels clients on issues pertaining to chemical hazard, exposure and risk assessment, and risk communication. She has earned an international reputation in the legal and regulatory aspects of conventional and nanoscale chemical regulatory programs under the Toxic Substances Control Act (TSCA), the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the European Union’s Registration, Evaluation, Authorization and Restriction of Chemicals (REACH), and on issues pertinent to nanotechnology and other emerging transformative technologies. Specialties include chemical product approval and regulation under TSCA, FIFRA, and REACH, as well as nanoscale substances and nanomaterials law, policy, and regulation.

Today, Ms. Bergeson works with corporations and a wide range of trade associations on evolving regulatory and policy matters pertinent to products of conventional, biotechnology, biobased chemicals, nanotechnologies, and other emerging technologies particularly with respect to TSCA, FIFRA, Food Quality Protection Act (FQPA), REACH and REACH-like programs, and Occupational Safety and Health Administration (OSHA) matters. She is widely published, and lectures frequently on legal, regulatory, and policy issues affecting chemicals under federal, state, and international regulatory programs.

Representative Engagements:

  • Assists a global manufacturer of industrial and consumer products register and maintain chemical product approvals in all jurisdictions in which its products are marketed.
  • Among the first U.S. law firms to assist several manufacturers of nanoscale chemical products obtain approval for their innovations under TSCA, and have devised and maintained product stewardship programs in multiple global jurisdictions to manage these nanoscale products effectively.
  • Among the first law firms judicially to challenge a Significant New Use Rule (SNUR) issued under TSCA Section 5 to eliminate or lessen commercial restrictions placed on the manufacture, processing, and distribution of a new chemical substance.
  • Assists several biobased chemical manufacturers address difficult TSCA nomenclature and chemical identity issues and devise and implement product stewardship protocols to manage these products with downstream stakeholders.
